TERMS AND CONDITIONS

Article 2. Offers/agreements

2.1 All offers by Country Classic Design are non-binding and Country Classic Design expressly reserves the right to change prices, in particular when required by (statutory) regulations. See also Article 3.6.
2.2 A contract comes into effect only after acceptance of your order by Country Classic Design. Country Classic Design is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Country Classic Design shall communicate this within ten (10) working days after receipt of the order.

Article 3. Prices and payments

3.1 The prices stated for the products and services offered are in Euros, including VAT and excluding handling and shipping costs, any taxes or other levies, unless otherwise stated or agreed in writing.
3.2 Payment shall be made without discount or compensation within fourteen (14) days of the invoice date in the case of deliveries within the Netherlands, and within twenty-one (21) days of the invoice date in the case of deliveries outside the Netherlands, unless otherwise agreed in writing.
3.3 Payment may be made by giro, in advance or upon receipt (cash on delivery). In the case of payment by bank or giro, the date of payment shall be the date on which the giro or bank account of .Country Classic Design is credited.
3.4 If the term of payment is exceeded, you will be in default from the day on which payment should have been made and will be liable to pay default interest of 1% per month or part of a month on the outstanding amount from that day. If payment is made after a reminder by Country Classic Design, you shall owe an amount of twenty-five euros (25.00) in administration costs and if Country Classic Design outsources its claim for collection, you shall also owe the collection costs, which shall be at least fifteen per cent (15%) of the outstanding amount, without prejudice to Country Classic Design's right to claim the actual extrajudicial collection costs incurred instead.
3.5 If you default on any payment, Country Classic Design shall be entitled to suspend or dissolve (the performance of) the relevant contract and related agreements.
3.6 If the prices for the products and services offered increase in the period between the order and its execution, you are entitled to cancel the order or dissolve the agreement within ten (10) days of Country Classic Design notifying you of the price increase.

Article 4. Delivery

4.1 The delivery times given by Country Classic Design are indicative only. Failure to meet any delivery deadline shall not entitle you to compensation, nor shall it entitle you to cancel your order or dissolve the agreement, unless the failure to meet the delivery deadline is such that you cannot reasonably be required to maintain the agreement. In that case, you are entitled to cancel the order or dissolve the agreement to the extent necessary.
4.2 Delivery of the products will take place at the place and time when the products are ready for dispatch to you. It is also important to mention that payments must be clear on our bank account! Please note e.g. Ideal payments are not immediately visible can sometimes take 4 to 5 working days!

Article 5. Retention of title

5.1 Ownership of delivered products is transferred only when you have paid all that you owe to Country Classic Design under any agreement. The risk in respect of the products shall already pass to you at the time of delivery.

Article 7. Complaints, returns and liability 7.1 You are obliged to examine upon delivery whether the products comply with the agreement. If this is not the case, you must notify Country Classic Design as soon as possible and in any case within seven (7) working days of delivery, at least after observation was reasonably possible, in writing/email and stating reasons.
7.2 If it has been demonstrated that the products do not comply with the agreement, Country Classic Design has the choice of replacing the relevant products with new products upon return or refunding the invoice value thereof.
7.3 If you do not wish to take delivery of a product for any reason, you are entitled as a private individual to return the product to Country Classic Design within seven (8) working days of delivery. Returns will only be accepted in this case if the product packaging is undamaged, whereby it also applies that the costs of return shipments are for your account.

7.4 Products which demonstrably do not have any defects and have been delivered as described in the advertisement may be returned, but handling costs will be charged!

Article 8. Guarantee

8.1 If Country Classic Design delivers products to the buyer, Country Classic Design shall never be held to any further warranty vis-à-vis the buyer than that to which Country Classic Design is entitled vis-à-vis its supplier. The warranty period shall always be clearly indicated on the invoice.
Complaints for externally visible defects must be submitted in writing in accordance with the contract terms, but at the latest within 7 (seven) days after receipt of the goods by the client. A period of 30 (thirty) days applies to Consumers. Claims received by Country Classic Design after this period has expired need not be processed by Country Classic Design.

Article 9. Orders/communication

9.1 Country Classic Design shall not be liable for misunderstandings, mutilation, delays or improper transmission of orders and messages resulting from the use of Internet or any other means of communication between you and Country Classic Design, or between Country Classic Design and third parties, insofar as these concern the relationship between you and Country Classic Design, unless and insofar as there has been intent or gross negligence on the part of Country Classic Design.

Article 10. Force majeure

10.1 Without prejudice to its other rights, Country Classic Design shall in cases of force majeure be entitled, at its discretion, to suspend execution of your order, or to dissolve the contract without judicial intervention, by notifying you in writing and without Country Classic Design being liable to pay any compensation, unless in the given circumstances this would be unacceptable according to the standards of reasonableness and fairness.
10.2 Force majeure means any shortcoming that cannot be attributed to Country Classic Design, because it is not due to its fault and is not for its account under the law, legal act or generally accepted practice.

Article 11. Miscellaneous

11.1 If you provide Country Classic Design with an address in writing, Country Classic Design shall be entitled to send all orders to that address, unless you notify Country Classic Design in writing of another address to which your orders should be sent.
11.2 If Country Classic Design has permitted departures from these Conditions for a short or longer period, tacitly or otherwise, this shall not affect its right to demand direct and strict compliance with these Conditions. You may never assert any right on the grounds that Country Classic Design applies these Conditions flexibly.
11.3 If one or more of the provisions of these Conditions or any other agreement with Country Classic Design should be in conflict with any applicable legal provision, the provision in question shall lapse and shall be replaced by a new similar provision determined by Country Classic Design.
11.4 Country Classic Design is authorised to use third parties in the execution of your order(s).

Article 12. Applicable law and competent court

12.1 Dutch law applies exclusively to all rights, obligations, offers, orders and agreements to which these Conditions apply, as well as to these Conditions.
12.2 All disputes between the parties will be submitted exclusively to the competent court in the Netherlands for that purpose.

NOTICE:

1) Door hardware is custom ordered for you, which is why all sizes and photos are included with each product so that you can clearly see what you are buying! These custom ordered items will therefore not be taken back!

2) All sizes of the products are listed in each advertisement, so please measure before purchasing because that is knowing!!! If items are returned because they do not fit, handling costs will be charged!

3) Likewise, products purchased that have been altered to suit you will not be taken back!

4) Please pay attention to good thick packing in case of damage because we cannot pay the return price, tip: insure your product during return, then NOTHING can go wrong!
